Neha Bora, the national president of the All-India Student Association, today moved the Delhi High Court, seeking quashing of a Delhi Police notice dated October 17 and directions to the police prohibiting any coercive action against her.
The notice required Bora to appear before a Special Executive Magistrate on October 19 and execute a bond of Rs. 10,000 with a surety for keeping peace. Bora alleged that the police notice is vague, factually incorrect and contains no evidence substantiating the “likelihood” of breach of peace. She further alleged that the preventative proceedings violated her fundamental rights.
As per Bora’s legal team, they are seeking an urgent hearing before the vacation bench.
Earlier on October 16, Bora was taken into preventative detention from Mandi House while she was on her way to participate in CJP’s “Lehra Do Tiranga” march. She was later released on the morning of October 17.
The Delhi Police had said that they released Bora after she completed formalities under Section 65 of the Delhi Police Act. As per Section 65, if a person resists or fails to comply with a directive issued by a police officer in discharge of his/her duties, the police can forcibly remove the person and release them when the reason for their removal ceases to exist.
The developments have come amid protests by opposition parties, student groups and civil society against the controversial Special Intensive Revision exercise and Chief Election Commissioner Gyanesh Kumar. Bora has emerged as one of the key faces of the protest.
